The principle of proportionality is an important principle which is used in administrative law of many legal systems. It is considered as a significant tool to control administrative decisions, especially administrative discretion and balancing the public and private rights in order to achieve certain objectives which is crucial for effective public administration. This principle is comparatively new in administrative law of Mongolia. Thus the understanding and the application of the principle in administrative court of Mongolia is vague therefore it has to be analyzed. Therefore, this paper will discuss: (i) the theoretical concept of the principle of proportionality, mainly elements and the scope/field of applicability; (ii) the principle of proportionality in administrative law of Mongolia: content of the principle in administrative law and the applicability in administrative courts; and (iii) this paper will try to emphasize the relevance of the principle as a tool of the public administration in enhancing equitable and sustainable development.
