A judge faces the task of interpreting the law, but the way of doing it differs in jurisdictions. The thesis is a descriptive and historical account of how statutory interpretation has developed in Mongolia. For that matter, the core approach to statutory interpretation, in the case of Mongolia, is based on an abstract approach, meaning that it is done in isolation of a concrete case by the Supreme Court. This approach affects the relationship between higher and lower courts in statutory interpretation by restricting the lower court. The tendency to emancipate from this abstract mode is determined, but path dependency plays a role. The latest findings show the attempt to transition to a casuistic interpretation and introduce casuistic precedent.
