Энэхүү бүтээл нь 2024 оны 5 дүгээр сарын 18-ний өдөр Монгол Улсын Их Сургуулийн Хууль Зүйн Сургууль дээр зохион байгуулагдсан Хууль зүйн ухааны доктор, Онц бөгөөд бүрэн эрхт элчин Лүдэвдоржийн Хашбатын нэрэмжит Олон улсын эрх зүйн чиглэлээрх англи хэл дээрх оюутны эрдэм шинжилгээний илтгэлийн уралдаанд зориулан бичиж, нэгдүгээр байр эзэлсэн болно.

International law has been developing since the 17th century, adopting different jurisprudence such as natural law and positive law throughout the centuries. During this development, positive law has gained influential ground in the development of international law. Such positivism was created and crafted by Western thinkers and colonial, imperialist powers who imposed their positive international laws on the colonized. Even after the abolishment of colonialism and new states emerged, escaping colonialism and imperialism, the colonial root in international law has not changed. This has led the new international community mostly consisting of developing nations to criticize the legitimacy of international law and how the imposed international law is illegitimate. Those nations soon realized changing the already-established international legal framework was not possible. Such realization allowed the developing nations to shape and interpret the existing international law to their own advantage, letting their voices be heard more effectively to the point where these developing nations have gained momentum in the development of international law which ultimately further legitimizes international law. In this momentum of international legal activity by developing nations, Mongolia has the opportunity to play a part in solidifying its stance as an influence on the development of international law while keeping national security in mind. Such activity by developing nations ultimately leads to the legitimacy of international law.

With this paper, I will be assessing different jurisprudence of international law regarding its legitimacy and how developing nations can increase their participation in international law. Such assessment is crucial as establishing the possibility and possible room for participation in the development of international law provides the theoretical basis for developing nations’ influence on international law. Basing this, I will be proposing an approach that Mongolia should develop and adopt in its further endeavors of international law.
