Article 65.1 of the Civil Code is a crucial provision in agency law in Mongolia. This article is based on the concepts of "tolerated authority" and "apparent authority." The Supreme Court has applied this article based on the concept of "apparent authority" in some of its decisions. However, the text of Article 65.1 does not provide any criteria regarding the good faith of the third party involved. So, the Court also does not examine whether the third party is acting in good or bad faith. Therefore, this paper proposes that the third party be in good faith when applying Article 65.1 of the Civil Code. In simpler terms, the third party referred to in Article 65.1 should be interpreted as someone who is not aware or cannot be aware of the agent's lack of power of representation.
